Board of Appeals

In those instances where a variance is requested and in accordance with Michigan Residential Code 2003, the Missaukee County Board of Appeals was created with the following authority:

Section R112.2. Limitations on authority.  An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equally good or better form of construction is proposed.  The board shall have no authority to waive requirements of this code.

Application for a variance shall be made in writing and delivered to the building department office.  The variance request must be submitted on the form, NOTICE OF APPEAL TO THE MISSAUKEE COUNTY APPEALS BOARD, as provided by the building department office.

Appeal meetings are scheduled on a demand basis only.  After the building department office receives a Notice of Appeal request form, Appeal Board Members are notified and the meeting is scheduled as soon as a quorum can be arranged, typically within one to two weeks of submission of the appeals request.  The appellant is then notified regarding the time and day of the meeting to assure compatibility with the meeting date.
